Kindly read the terms carefully. These terms and conditions come into effect when you use eSouqs services (websites or mobile applications). By using the services of eSouqs, you are agreeing to the terms and services of eSouqs.
1, SERVICE TERMS
eSouqs implements website and mobile app-based delivery services for goods such as food, beverages, staples, groceries, and other supermarket products.
eSouqs is a medium developed for the transfer of services between customers who like to order goods online via our partners (Stores) that are ready to handle and deliver customer orders.
2, PROCESS TERMS
2-1, REGISTRATION
Your step of registration confirms that you agree to the Terms and Conditions Service and the Privacy Policy Of eSouqs, and you declare that you are not less than 21 (twenty-one) years of age. The information needed for registration presented by the user of eSouqs needs to be complete and correct. Customer registration in eSouqs is free of cost. You are the authorized user of any account you create using the eSouqs platform. eSouqs is not liable for the use of the customer account and expressly denies any responsibility therefrom. The User is liable for updating his/her information that can be altered anytime from the corresponding interface of the platform. If you suspect that any unauthorized or unapproved activity in your account, you are bound for your security to report eSouqs about the activity.
By providing your mobile phone number to eSouqs to use the platform, you hereby agree to our use of your mobile phone number for contacting you directly to deliver our services, including but not limited to occasionally communicate or send notifications/updates/promotional offers/surveys concerning the quality of our service.
2-2, PLACEMENT OF ORDER
Upon placing an order through the eSouqs platform, the customer confirms the correctness of all the data he/she presents. Orders are confirmed to the User within the interface. Customers may schedule the order for their preferred time as per the service availability. eSouqs may determine for any reason whatsoever to not accept an order and to decline to deliver it.
2-3, ORDER VOLUME AND PRICE
In all circumstances, eSouqs reserves the freedom to limit the delivery quantity for particular products or, if required, not to deliver a particular product at all as per the availability of the products.
The price and product range may vary depending on the delivery location. eSouqs may contact the customer if the total items exceed 100 items in the order/order contains more than 15 quantities of the same product/more than one delivery person is needed to fulfill the order due to volume limitations.
2-4, ORDER ACTIONS
The customer may not be able to modify the order once it has been confirmed by eSouqs. An accepted order is qualified for cancellation only for a limited period until it is dispensed for the fulfillment post to its submission.
2-5, INCOMPLETE ORDER FULFILLMENT
eSouqs reserves the right to forward an order to a different store than the one originally chosen from the customer without notifying the customer if the original store fails to meet the order. In that case, the new shop approves the total value of the goods ordered should be the same or lower than the price of the first shop without affecting the payment method.
2-6, DELIVERY
Products will be delivered to the delivery address provided by the customer. Fulfillment will be done either by the Shop/delivery partner/eSouqs based on product availability and customer location.
eSouqs attempts to fulfill deliveries within 30 to 60 minutes but cannot guarantee that the delivery time frames will be met as there may be factors outside of eSouqs control that may result in early or slowed shipments. Fulfilling stores hold the responsibility to present the customer with the receipt upon fulfillment. For factors such as customer absence on delivery, incorrect delivery address, bad weather, lack of access permissions, or similar situations. In such situations, eSouqs is authorized to cancel customer orders. In this event, the customer is not entitled to compensation though; in case of online payment, the refund will be initiated by eSouqs as earliest as possible. However, refunds may take 3 to 5 business days to reflect in the customer account after processing when it comes to online transactions.
2-7, PRICES
All prices are quoted in the country’s local currency where eSouqs are operating. It may be inclusive of VAT depending on the country.
3 GENERAL TERMS
3-1, DATA PROTECTION
When registration is done, your information such as last name, first name, address, email address, and phone number is collected for business and marketing purposes.eSouqs creates a separation between your master data ( IP address, date, and time, etc.) and activity data (file names, paths, etc.). For statistical purposes, the data is anonymously evaluated. eSouqs may share your delivery related data with partner supermarkets for the fulfillment of orders. We may regularly make modifications to improve the functionality at any time without notice.
3-2, DISCLAIMER
Use the platform at your own risk. We may periodically make changes to improve the functionality at any time without notice. eSouqs assumes no responsibility for any errors/inaccuracies of content, property or personal accidents, or damage resulting from the use of the platform. eSouqs does not take responsibility for virus attacks, spam, hacks, or any internet or server and content-related issues. eSouqs makes no guarantee that any personal data supplied by customers will not be erased, damaged, misappropriated, or used by others.
